I am a single dad, living in Denver and trying to raise funds to help pay my legal fees in my effort to gain more parenting time with my two children. I am disabled and have been for almost ten years. I am trying to get back on my feet, but right now I am on a fixed income and struggling to make ends meet. I am very worried about losing my attornery and would be grateful for any assistance you can offer.
My children are in elementary school and I want to protect their privacy, so I will not be using their names on this website. Neither will I be using my ex-wife's name for privacy reasons.
At this time, my kids are with me from 9am Sunday morning until I take them to school on Monday morning and then Monday, Tuesday and Wednesday from 3:45pm to 8pm. During the summer the kids alternate between my house and their mom's house, for two weeks at a time.
Until my ex-wife and I separated I spent most of the previous ten years as a stay-at-home dad caring for my kids and my step children from my ex-wife's previous marriage. During many of these years I was struggling with health problems, including a seizure disorder for which the cause was never discovered. In 2002 I also began experiencing painful and severe muscle spasms that were diagnosed as dystonia. Through all of this I continued to take care of the kids.
When I moved out of the house, my ex began to argue that due to my disabilities I couldn't take care of the kids, especially overnight. We tried mediation a couple times in 2006 which got us nowhere. My lawyer felt my best option was to get a family investigator involved.
In Nov 2006 we went to court. The family investigator was very supportive. She told the court that she had investigated me, my home and my medical records and that she saw no problem with the kids being with me. She recommended the shared parenting schedule that we have now. She also told the court that this schedule was a starting point to work toward equal parenting time for myself and my ex. While this was a huge step forward, it also meant many hours of legal work just to get to this point.
It has been more than a year since we went to court for our divorce. My disabilities have had no negative affect on my kids in this time and no harm has ever come to them because of my disabilities. My medical issues still exist, but are slowly improving.
I was the person who was always home to care for the kids. I don't think this should have drastically changed because of a divorce. Even though I miss being a full-time dad, I would be ok with sharing parenting time equally with my ex if I thought her home was a healthy environment for my kids. I don't believe it is at this time. It's very important to me that my children be loved and cared for like they deserve to be.
